These Terms & Conditions ("Terms", "Agreement") constitute a legally binding agreement between Krishna Shorthand Institute (proprietorship/entity operating ShorthandDictation.com) and you ("User", "You", "Your", "Subscriber").

2. DEFINITIONS & INTERPRETATION
2.1 Definitions:
"Content" means all dictations, audio files, video lectures, PDFs, study materials, practice exercises, and any other educational resources provided on the Platform
"Subscription" means the paid access plan purchased by the User for a specified duration
"Intellectual Property" includes but is not limited to copyrights, trademarks, trade secrets, proprietary methods, course materials, and all content
"Services" means all educational services, content delivery, and platform access provided by ShorthandDictation
2.2 Interpretation:
Headings are for convenience only and do not affect interpretation
Words in singular include plural and vice versa
"Including" means "including without limitation"
3. NATURE OF PLATFORM & SERVICES
ShorthandDictation.com is an educational and skill development platform providing:
Shorthand dictations (legal, judicial, parliamentary, general, and specialized)
Practice materials and transcription exercises
Educational videos, audio content, and downloadable resources
Skill-enhancement tools and learning resources
Speed building exercises and evaluation materials

3.1 This Platform provides educational content only for skill development purposes.
3.2 ShorthandDictation makes NO WARRANTIES, GUARANTEES, OR REPRESENTATIONS of any kind, express or implied, including but not limited to:
❌ Selection in any examination, court, tribunal, or government position
❌ Employment, job placement, or career advancement
❌ Examination success, passing marks, or qualification
❌ Achieving any specific speed in shorthand
❌ Accuracy, completeness, or reliability of content
❌ Fitness for a particular purpose
❌ Uninterrupted or error-free service
3.3 All outcomes depend solely and exclusively on:
Individual effort, dedication, and practice
Personal aptitude and learning ability
External factors beyond our control
User's own skill development and application
3.4 ShorthandDictation is NOT responsible for any third-party examination boards, selection processes, marking schemes, or evaluation criteria.
4. USER ELIGIBILITY & REPRESENTATIONS
4.1 By using this Platform, you represent, warrant, and confirm that:
You are at least 18 years of age OR using the Platform under the supervision and consent of a parent/legal guardian
You possess full legal capacity and competence to enter into a binding contract under the Indian Contract Act, 1872
You are not barred or prohibited by any law from using this Platform
All information provided during registration is true, accurate, current, and complete
You will comply with all applicable laws of India while using this Platform
4.2 If you are a minor (below 18 years), your parent/legal guardian must review and accept these Terms on your behalf and shall be held liable for all your actions.
5. ACCOUNT REGISTRATION, SECURITY & USAGE RESTRICTIONS
5.1 Account Registration:
You must provide accurate and complete information during registration
You must maintain and promptly update your account information
You are solely responsible for all activities under your account
5.2 Account Security - Your Responsibilities:
Maintaining strict confidentiality of your username, password, and login credentials
Using strong, unique passwords not shared with other platforms
Immediately notifying us of any unauthorized access or security breach
Not allowing any third party to access your account
5.3 Strict Usage Policy - One Account = One Individual:
Each subscription/account is licensed for single individual use only
Account sharing is strictly prohibited
Simultaneous login from multiple devices/IPs will be monitored and may result in suspension
5.4 Prohibited Actions:
Users shall NOT:
Share login credentials with family, friends, or any third party
Allow multiple users to access a single account
Resell, redistribute, or commercially exploit subscription access
Use VPN or proxy services to circumvent security measures (unless legitimately required for access)
Create multiple accounts to exploit free trials or promotional offers
Use automated tools, bots, or scripts to access the Platform
🚫 CONSEQUENCES OF VIOLATION:
ShorthandDictation reserves the absolute and unfettered right to:
Immediately suspend or permanently terminate the account without prior notice
Cancel subscriptions without any refund whatsoever
Block IP addresses and devices
Pursue civil and criminal legal action under applicable Indian laws including:
Information Technology Act, 2000
Indian Copyright Act, 1957
Indian Contract Act, 1872
Claim damages, compensation, and legal costs
5.5 No warning or notice is required before account termination for violations.
6. SUBSCRIPTION, FEES, PAYMENTS & NO REFUND POLICY
6.1 Payment Terms:
All fees displayed on the Platform are in Indian Rupees (INR) unless otherwise specified
Prices are subject to change without notice
Payment must be made through authorized payment gateways only
You are responsible for all applicable taxes, if any
6.2 Subscription Characteristics:
Subscriptions are time-bound and commence from the date of purchase
Subscriptions are strictly non-transferable to any other person
Access duration cannot be paused, frozen, or extended for any reason
Unused subscription time is forfeited and non-refundable
❗ ABSOLUTE NO REFUND POLICY
6.3 Once payment is made and processed, the transaction is FINAL, CONCLUSIVE, AND BINDING.
NO REFUND, NO CANCELLATION, NO EXCHANGE under any circumstances whatsoever, including but not limited to:
❌ Non-attendance or non-use of the Platform
❌ Change of mind or decision
❌ Dissatisfaction with content (subjective or otherwise)
❌ Technical issues from your side (device, internet, compatibility)
❌ Personal emergencies, illness, or unavailability
❌ Failure in examination, test, or assessment
❌ Non-selection in job or competitive examination
❌ Relocation, travel, or change in circumstances
❌ Account suspension due to Terms violation
❌ Force majeure events
❌ Any other reason whatsoever
6.4 No Partial Refund Claims:
No refund shall be provided for partial usage, reduced usage, or non-usage
"I didn't know" or "I didn't read the Terms" is not a valid ground for refund
6.5 By completing payment, you explicitly acknowledge and accept this No Refund Policy and waive any and all rights to claim refund, chargeback, or reversal.
6.6 In case of unauthorized chargeback or payment disputes raised with banks/payment gateways:
Your account will be permanently banned
Legal action may be initiated for fraud and breach of contract
You will be liable for all legal costs and damages
7. CONTENT AVAILABILITY, MODIFICATION & DISCLAIMER
7.1 Indicative Nature of Content:
Number of dictations, videos, PDFs, or resources mentioned in any plan are approximate and indicative only
Content is added progressively and periodically at our sole discretion
Content availability may vary based on technical, operational, or educational considerations
7.2 Right to Modify:
ShorthandDictation reserves the absolute and unconditional right to:
Add, modify, update, replace, or remove any content at any time
Change the format, structure, or delivery method of content
Alter schedules, timelines, or release dates
Reorganize or restructure course materials
Discontinue certain content or features without notice
Update content to reflect current practices or standards
7.3 No Claims:
No claim, complaint, or demand shall arise due to content modification, replacement, or removal
No compensation or refund shall be provided for content changes
We are not obligated to maintain historical versions of content
7.4 Content is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
8. INTELLECTUAL PROPERTY RIGHTS & PROTECTION
8.1 Ownership:
All content, materials, and resources on this Platform including but not limited to:
Shorthand dictations (legal, general, specialized)
Audio files, video lectures, and multimedia content
PDF documents, study materials, and handouts
Website design, layout, graphics, and user interface
Logos, trademarks, branding elements, and proprietary marks
Software, code, algorithms, and technical implementations
Teaching methodology, course structure, and curriculum design
Transcripts, answer keys, and evaluation materials
are the exclusive intellectual property of ShorthandDictation / Krishna Shorthand Institute and are protected under:
The Indian Copyright Act, 1957
The Trade Marks Act, 1999
Information Technology Act, 2000
Common law principles of intellectual property
8.2 Limited License:
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use content solely for personal, non-commercial learning purposes
This license terminates immediately upon subscription expiry or account termination
8.3 Strict Prohibitions - Users May NOT:
❌ Record, capture, screenshot, or download any content by any means
❌ Copy, reproduce, duplicate, or replicate content in any form
❌ Distribute, share, transmit, or disseminate content to third parties
❌ Upload, post, or publish content on YouTube, Telegram, WhatsApp, Instagram, Facebook, or any other platform (social media or otherwise)
❌ Use content for commercial purposes, teaching, coaching, or training others
❌ Create derivative works based on our content
❌ Remove or alter any copyright notices, watermarks, or proprietary markings
❌ Reverse engineer, decompile, or disassemble any software or technical components
❌ Use screen recording software, capture tools, or any recording devices
❌ Print, photocopy, or physically reproduce materials (unless expressly permitted)
❌ Sell, rent, lease, or sublicense access to content
8.4 Monitoring & Detection:
We employ technical measures to detect unauthorized recording, downloading, or distribution
Digital watermarking and tracking mechanisms may be embedded in content
8.5 Legal Consequences of Infringement:
Any violation shall constitute:
Civil infringement under Sections 51, 55, 58 of the Copyright Act, 1957 - liable for injunction, damages, and account of profits
Criminal offense under Section 63, 63-B of the Copyright Act - punishable with imprisonment (6 months to 3 years) and fine (₹50,000 to ₹2,00,000)
Violation of Information Technology Act, 2000
Breach of contract entitling us to damages and specific performance
8.6 We will pursue aggressive legal action including:
Civil suits for damages, injunctions, and account of profits
Criminal prosecution under Copyright Act
Claims for statutory and actual damages
Recovery of legal fees and costs
9. PROHIBITED CONDUCT & USER OBLIGATIONS
9.1 Users must conduct themselves in a professional, respectful, and lawful manner.
9.2 Absolutely Prohibited - Users Must NOT:
Use abusive, threatening, defamatory, obscene, or offensive language
Harass, intimidate, bully, or threaten faculty, staff, administrators, or other users
Post false allegations, misleading claims, or defamatory statements
Make baseless complaints or frivolous demands
Misuse social media platforms (Facebook, Instagram, Twitter, etc.) to defame, disparage, or malign ShorthandDictation
Post negative reviews based on false information or malicious intent
Engage in cyberbullying, trolling, or online harassment
Impersonate staff, faculty, or other users
Spam, advertise, or promote other services on our Platform
Engage in any unlawful activity through the Platform
Attempt to hack, disrupt, or compromise Platform security
Use the Platform to transmit viruses, malware, or harmful code
9.3 Zero Tolerance Policy:
We maintain a zero-tolerance approach to misconduct
First violation may result in immediate account termination
No warnings are required before termination
9.4 Defamation & Disparagement:
False or misleading statements about ShorthandDictation on any platform (online or offline) shall be treated as defamation under Sections 499-502 of the Indian Penal Code, 1860
We reserve the right to pursue criminal and civil remedies for defamatory content
10. ACCOUNT SUSPENSION, TERMINATION & CONSEQUENCES
10.1 Our Rights:
ShorthandDictation reserves the absolute, unconditional, and unfettered right to:
Suspend or terminate any user account immediately and without prior notice
Cancel active subscriptions without refund or compensation
Block access to Platform and all content
Remove or disable user-generated content
Report violations to law enforcement authorities
Pursue legal remedies
10.2 Grounds for Termination (Non-Exhaustive):
Breach or violation of any Term or Condition
Misconduct or prohibited conduct as defined herein
Intellectual property infringement
Account sharing or credential misuse
Fraudulent activity or payment disputes
Defamation or disparagement
Malicious intent or harmful activities
Harassment of staff or users
Use of Platform for unlawful purposes
Any action detrimental to ShorthandDictation's interests
At our sole discretion for any reason or no reason
10.3 Effect of Termination:
Immediate loss of access to all content and services
Forfeiture of all fees paid (no refund)
Cancellation of all rights and licenses granted
User remains liable for all obligations accrued before termination
Survival of certain clauses (indemnity, limitation of liability, governing law)
10.4 Termination does not waive our right to pursue legal action or claim damages.
11. DISCLAIMER OF WARRANTIES
11.1 TO THE MAXIMUM EXTENT PERMITTED UNDER INDIAN LAW:
ShorthandDictation provides the Platform and all content on an "AS IS", "AS AVAILABLE", and "WITH ALL FAULTS" basis.
11.2 WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, whether express, implied, or statutory, including but not limited to:
Merchantability
Fitness for a particular purpose
Title and non-infringement
Accuracy, reliability, or completeness of content
Uninterrupted, timely, secure, or error-free service
Results or outcomes from using the Platform
Correction of defects or errors
11.3 We do not warrant that:
The Platform will meet your specific requirements
Content is current, accurate, or applicable to your situation
Any defects will be corrected
The Platform is free from viruses or harmful components
11.4 You acknowledge that Internet transmissions are never completely secure, and we cannot guarantee security of information transmitted through the Platform.
12. LIMITATION OF LIABILITY & INDEMNIFICATION
12.1 LIMITATION OF LIABILITY:
TO THE FULLEST EXTENT PERMITTED BY LAW, ShorthandDictation, its owner, directors, employees, affiliates, partners, and representatives shall NOT BE LIABLE for any:
Direct Damages:
Academic failure or poor performance
Non-selection in examinations, interviews, or recruitment processes
Job loss or unemployment
Financial losses or lost profits
Loss of business opportunities
Examination fees or related expenses
Indirect, Consequential, or Special Damages:
Loss of time, effort, or opportunity
Mental distress, anxiety, or emotional harm
Damage to reputation or career
Loss of data or content
Any other consequential damages
Technical Issues:
Platform downtime, outages, or unavailability
Server failures or technical glitches
Compatibility issues with your devices
Internet connectivity problems
Third-party service failures (payment gateways, hosting providers)
Data loss or corruption
Third-Party Actions:
Actions or omissions of payment processors, banks, or financial institutions
Examination conducting bodies or government authorities
Other users' conduct
External website links or references
12.2 Maximum Liability Cap:
In any event, our total aggregate liability shall not exceed the amount actually paid by you for the specific subscription in question
This cap applies regardless of the cause of action (contract, tort, negligence, strict liability, or otherwise)
12.3 Risk Assumption:
You expressly understand and agree that use of the Platform is entirely at your own risk
You assume full responsibility for any consequences of using or relying upon the content
12.4 INDEMNIFICATION:
You hereby agree to indemnify, defend, and hold harmless ShorthandDictation, Krishna Shorthand Institute, its proprietor/owner, directors, officers, employees, agents, affiliates, partners, and representatives from and against any and all:
Claims, demands, or causes of action
Losses, damages, liabilities, or expenses (including reasonable attorney fees and legal costs)
Penalties, fines, or sanctions
Arising out of or relating to:
Your use or misuse of the Platform
Your violation of these Terms
Your violation of any law or rights of third parties
Your negligent or wrongful conduct
Content you post or transmit through the Platform
Intellectual property infringement
Defamatory statements or false allegations made by you
Breach of any representation or warranty
12.5 This indemnification obligation survives termination of these Terms and your use of the Platform.
13. NO PROFESSIONAL, LEGAL, OR EMPLOYMENT ASSURANCE
13.1 Educational Purpose Only:
All content is provided solely for educational and skill development purposes
Content is not tailored to any specific examination, job, or selection process
13.2 Not Professional Advice:
No content on this Platform shall be construed or relied upon as:
Legal advice or legal opinion
Professional career counseling
Official examination guidance or inside information
Employment guarantee or job placement service
Coaching for specific government or court examinations
Endorsement by any judicial, governmental, or official body
13.3 You should:
Consult appropriate professionals (lawyers, career counselors) for specific advice
Refer to official examination notifications and guidelines

13.4 ShorthandDictation has no affiliation with any court, tribunal, government department, public service commission, or examination conducting body.
14. FORCE MAJEURE
14.1 ShorthandDictation shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
Acts of God (earthquakes, floods, storms, pandemics)
War, terrorism, civil unrest, or riots
Government orders, regulations, or restrictions
Internet service failures or telecommunications disruptions
Power outages or infrastructure failures
Labor disputes or strikes
Cyberattacks or hacking incidents
Any other unforeseen circumstances
14.2 During force majeure events, our obligations shall be suspended, and no liability or refund obligation shall arise.
15. DISPUTE RESOLUTION & ARBITRATION
15.1 Mandatory Negotiation:
Before initiating any legal proceedings, parties agree to attempt good faith negotiation for 30 days
Notice of dispute must be sent in writing to our registered address
15.2 Arbitration (Optional Clause):
If negotiation fails, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996
Arbitration shall be conducted by a sole arbitrator mutually appointed
Seat of arbitration: Prayagraj, Uttar Pradesh
Language: English/Hindi
Arbitrator's decision shall be final and binding
15.3 Notwithstanding arbitration provisions, ShorthandDictation retains the right to seek injunctive relief or pursue legal action in courts for:
Intellectual property infringement
Breach of confidentiality
Urgent matters requiring immediate relief
16. GOVERNING LAW & EXCLUSIVE JURISDICTION
16.1 Governing Law:
These Terms and Conditions, and all disputes arising out of or in connection with these Terms, shall be governed by, construed, and enforced in accordance with the laws of India, including but not limited to:
The Indian Contract Act, 1872
The Information Technology Act, 2000
The Indian Copyright Act, 1957
The Consumer Protection Act, 2019 (where applicable)
Any other applicable Indian legislation
16.2 EXCLUSIVE JURISDICTION:

Breach of contract
Intellectual property matters
Payment disputes
Any other matter connected with the Platform
Shall be subject to the EXCLUSIVE JURISDICTION of the competent courts located in:
PRAYAGRAJ (ALLAHABAD), UTTAR PRADESH, INDIA ONLY
16.3 Waiver of Other Jurisdictions:
You expressly and irrevocably waive any objection to jurisdiction or venue in Prayagraj courts
You agree not to commence or maintain any action in any other jurisdiction
You waive any right to claim that Prayagraj courts are an inconvenient forum
This clause applies regardless of your location, residence, or place of transaction
16.4 This exclusive jurisdiction clause is a material term and shall be binding and enforceable to the fullest extent permitted by law.
17. SEVERABILITY & WAIVER
17.1 Severability:
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable
The remaining provisions shall continue in full force and effect
Invalid provisions shall not affect the validity of the entire Agreement
17.2 Waiver:
Failure or delay by ShorthandDictation to enforce any right or provision shall not constitute a waiver of such right or provision
No waiver shall be effective unless in writing and signed by authorized representative
Waiver of one breach does not waive subsequent breaches
18. ENTIRE AGREEMENT & AMENDMENTS
18.1 Entire Agreement:
These Terms, together with the Privacy Policy and any other referenced policies, constitute the entire agreement between you and ShorthandDictation
These Terms supersede all prior or contemporaneous agreements, understandings, representations, or communications (oral or written)
18.2 Right to Modify:
ShorthandDictation reserves the absolute right to:
Modify, amend, update, or revise these Terms at any time
Add new terms or remove existing terms
Change policies, fees, or service structure
Make changes without prior notice or consent
18.3 Notification of Changes:
Updated Terms will be posted on the Platform with revised "Last Updated" date
Material changes may be notified via email or Platform notification (at our discretion, not obligatory)
18.4 Acceptance of Modifications:
Your continued use of the Platform after modifications constitutes your binding acceptance
If you do not agree to modifications, you must immediately cease using the Platform
No refund shall be provided for discontinuing use due to Term modifications
18.5 It is your responsibility to regularly review these Terms for updates.

19.2 Grievance Redressal:
Grievances will be acknowledged within 48 hours (working days)
We will attempt to resolve grievances within reasonable time
Resolution is subject to our Terms and policies
19.3 Contact does not waive any rights or modify any Terms.
20. FINAL ACKNOWLEDGEMENT & ACCEPTANCE
By creating an account, making a payment, accessing content, or using ShorthandDictation.com in any manner whatsoever, you explicitly, unconditionally, and irrevocably acknowledge, confirm, accept, and agree that:

✅ You understand and accept the ABSOLUTE NO REFUND POLICY under all circumstances
✅ You understand that all outcomes depend solely on your individual effort and ShorthandDictation makes no guarantees of success, selection, or employment
✅ You agree to the EXCLUSIVE JURISDICTION of courts in Prayagraj, Uttar Pradesh for all disputes
✅ You waive any and all rights to:
Claim refunds, cancellations, or exchanges
Initiate litigation in any jurisdiction other than Prayagraj, Uttar Pradesh
Challenge the validity or enforceability of these Terms
Seek remedies inconsistent with the limitations stated herein
✅ You acknowledge that these Terms are fair, reasonable, and enforceable
✅ You have had sufficient opportunity to seek independent legal advice before accepting these Terms
✅ You are entering into this Agreement voluntarily with full knowledge and understanding
21. SURVIVAL OF TERMS
The following provisions shall survive termination or expiry of these Terms:
Intellectual Property Rights (Section 8)
Limitation of Liability (Section 12)
Indemnification (Section 12.4)
Governing Law & Jurisdiction (Section 16)
Dispute Resolution (Section 15)
Any provision that by its nature should survive
